Legal address and actual address – difference of terms
The term “actual address” is often used in everyday life and may include the address of a physical person or the address of legal person’s office, but the “legal address” is used only for legal persons. We often face the fact that a legal person can have two different addresses – the legal and the actual address.
The legal address is the official address of the merchant from the legal point of view, therefore in the case of correspondence, the address of the merchant must be used as a postal address (especially in legal matters).
Legal address – general information
When registering a merchant in the Commercial Register, the applicant must indicate the legal address and submit the written consent of the owner of the property at the registered office with the permission to use the legal address.
The legal address is one of the most important properties of the merchant and it is publicly available.
The legal address is the official address of the merchant, where the board must be accessible by law and in which correspondence must be received.
All public authorities will only send correspondence to your legal address, regardless of the actual address of your office.
By law, a postal item is considered as delivered on the 7th (seventh) day from the date of its dispatch. Respectively, if the sender can prove the fact of sending the item (for example, by mail receipt), the item will automatically be considered as delivered regardless of whether you received it or not.
It is therefore very important to indicate only the legal address to which you have actual and regular access.
If a non-existent legal address or address that is not listed in the State Address Register is indicated, the registration of the merchant may be postponed until the elimination of the deficiencies.
